FERPA is an act that refers to the FEDERAL EDUCATIONAL RIGHT AND PRIVACY ACT. This act came into force in 1974. The main motive of the FERPA act is to protect the right to privacy of students and their parents. It is a document that is signed to keep some of the student’s personal information private.

FERPA WAIVER is a document that is signed during the admission process by students to keep their LOR and other personal documents confidential. Waiving your right indicates that you have no intention of reading your recommendation letters, making them honest and trustworthy. Unless you surrender your right, most teachers or lecturers will refuse to write you a letter of recommendation.

If a student believes his or her rights under FERPA have been violated, he or she should submit a complaint with the U.S. Department of Education. Office of Family Policy Compliance, Department of Education (FPCO). The FPCO will now investigate and review the situation.

Rights included in FERPA

Students and their families have been informed of their rights by educational institutions. This notification must be sent out once a year.

Here are the rights included under FERPA.

1.            The right to see a student’s educational records to ensure that their content is accurate.

2.            The right to request that records be corrected if a parent or student believes they are incorrect.

3.            The right to object to the dissemination of personal information to third parties. A third party is anyone who is neither the student nor the student’s parents, including individuals or organizations.

FERPA prohibits a student’s protected information from being disclosed to a third party without the student’s consent. There are three types of protected information under FERPA:

1.         Educational Records

This category includes student’s grades, financial records, and statements, Course schedules, etc.

2.         Personal Identifiable information

This category includes the details about a person to track someone. There are two types of categories under this head.

a.            Direct identifier- Personal information such as the name of the student, School’s name, address, and Student’s registration or identification number.

b.            Indirect Identifier- Other details such as religion, tribe, employment, etc.

3.         Directory Information

This contains details and information provided in the school magazine or pamphlet. If a school has received public notice, it is permitted to share this information with a third party. The information includes the pupils’ names, addresses, phone numbers, and email addresses, among other things.

1.            Parents and kids have the right under FERPA to have any incorrect details or information about a student that has been recorded into the record system corrected. Before the amendment, the original and correct information must be proved.

2.            When a student reaches the age of 18, his or her rights are transferred from his or her parents to the student, who is now responsible for his or her paperwork, details, and information.
